Enforcement of cross-border cargo regulations has significantly increased during the Trump administration, causing delays and financial burdens for shippers. According to industry experts, there has been a surge in freight inspections and penalties at the border, reflecting a more protectionist stance by the United States Customs authorities.

Breanna Leininger, overseeing U.S. operations at Pacific Customs Brokers in Vancouver, described the substantial changes in customs procedures. The requirement for documentation on shipped goods has multiplied by ten compared to previous years. The scrutiny by customs officials has intensified, with a noticeable rise in the frequency of deeper inspections, now occurring multiple times a day for the 5,000 customers using their services.

Importers are now facing increasing demands for comprehensive paperwork to demonstrate compliance with product classifications and trade agreements. The complexity and extent of the information requested, including labor and manufacturing records, appear to be evolving continuously, making it challenging for businesses to keep up.

Official data supports reports of stricter enforcement measures. U.S. Customs and Border Protection audits are projected to increase by 26% compared to the previous year. In the first half of the current year, trade penalties totaling $70.6 million US were collected, marking a significant surge from previous years.

The heightened enforcement actions coincide with a growing trade conflict between Canada and the U.S., leading to additional tariffs being imposed by both countries. These border restrictions and delays in verifying product records are driving up costs and discouraging cross-border trade, as pointed out by Alan Dewar, the executive vice-president at GHY, a customs brokerage in Winnipeg.

In response to these challenges, some businesses are finding it increasingly difficult to navigate the complex regulations, with some even considering giving up due to the daunting nature of the compliance requirements. U.S. Customs and Border Protection emphasized the importance of importers providing accurate and complete information to ensure compliance with trade regulations.

Overall, the evolving trade landscape and stringent enforcement measures are reshaping cross-border commerce, creating both financial and logistical hurdles for businesses operating in North America.
