The Crown is challenging a recent mistrial declared in the sexual assault conviction of Frank Stronach. The billionaire was convicted in June of sexual assault and indecent assault in his Toronto trial. The mistrial on the sexual assault charge was granted by Superior Court Justice Anne Molloy after emails from the woman’s lawyer in a civil complaint were presented in court. Stronach’s lawyer, Leora Shemesh, argued that these emails contradicted the woman’s testimony. The Crown filed an appeal, contending that Justice Molloy erred in assuming solicitor-client privilege on the emails and in not addressing credibility concerns. They are seeking to reinstate the guilty verdict on the sexual assault charge and proceed with sentencing in Superior Court. Stronach, the founder of Magna International, originally faced multiple charges dating back to the late 1970s and 1990s involving seven complainants. After the trial concluded, some charges were dropped, and Stronach was acquitted on others. He is currently awaiting sentencing on the indecent assault conviction.
