Ryanair has emerged victorious in a crucial legal battle against Flightright, a company that assists passengers in obtaining compensation for flight delays and cancellations. A court in Germany has sided with Ryanair, issuing multiple rulings against Flightright. The court has prohibited Flightright from suggesting that customers face difficulties when reaching out to the airline’s customer service.

This legal decision is seen as a significant development in the ongoing conflict between the Irish budget airline and firms specializing in enforcing compensation claims under EU Regulation 261. Recently, the Hanseatic Higher Regional Court in Hamburg, Germany, has barred Flightright from advising passengers to disregard Ryanair entirely. Additionally, the court mandated that Flightright disclose a 14 percent “lawyer surcharge” added to its advertised fee.

Any future breach of the court’s ruling will incur a substantial £210,000 penalty. Ryanair has accused Flightright of deceptive advertising and profiting from the inconvenience experienced by delayed passengers. According to Ryanair’s marketing chief, Dara Brady, passengers who directly engage with the airline will receive the full compensation entitled to them under EU Regulation 261.

Brady emphasized that Ryanair offers a straightforward and transparent process that avoids excessive fees. EU regulations stipulate compensation of €250 for flight delays up to 1,500 kilometers and €600 for longer flights delayed over three hours.

The ruling is the latest setback for Flightright in a series of legal defeats. Claims companies have faced criticism for selectively pursuing easy compensation claims to maximize profits. Industry insiders note that Ryanair’s refund process is simpler compared to its competitors, leveraging this advantage to discredit companies that paint Ryanair as unfriendly to customers.

Travelers who prefer not to engage directly with airlines can utilize Germany’s free arbitration service, boasting an 80 to 90 percent success rate without charging fees. The ruling sheds light on the profit-driven nature of the claims industry, emphasizing a focus on capitalizing on delay payouts rather than serving the public.

On Flightright’s website, the company informed customers about their rights regarding flight delays and the potential for compensation. It highlighted conditions for eligibility, such as the airline’s responsibility for the delay and a minimum three-hour delay upon reaching the final destination.
